UBIC Presents “Roadblocks and Detours: Navigating Pan-Asian Data Privacy Laws” at 2012 ACEDS Conference

Industry Expert Presents on Navigating Barriers, Obstacles and Roadblocks Affecting U.S. Legal Discovery in Asian Jurisdictions

The session, titled Roadblocks and Detours: Navigating Pan-Asian Data Privacy Laws, considers the effect of new data privacy laws enacted in the Asia-Pacific region, which pose serious challenges and risks to the execution of U.S. legal discovery in those regions, according to John Bace, UBIC Advisory Board member and former Gartner Inc. Research Analyst. Mr. Bace is scheduled to make the presentation at the ACEDS Conference.

Execution at Risk 
Similar to what has occurred in Europe in recent years, many Asian states are enacting rigorous privacy laws and regulations designed to impede or block certain discovery requirements issued in U.S. legal proceedings that involve foreign litigants. These challenges are neither insignificant nor toothless. Missteps and mistakes in failing to comply with European privacy laws have resulted in government fines and sanctions and, in at least one case, the incarceration of an organization’s lawyer.

UBIC’s presentation at ACEDS will evaluate emergent regulation and statutes in the Pan-Asia region with respect to legal and practical strategies that ensure that data privacy obligations are met while at the same time complying with eDiscovery obligations imposed by the U.S. legal system.

Presenter John Bace is a Certified Compliance and Ethics Professional (CCEP) and a member of The Sedona Conference working groups on electronic document retention, management, and disclosure.
