Collecting, Preserving & Reviewing Data from Messaging Systems & Mobile: Key Takeaways

On Tuesday, March 26, 2019, the NY Metro chapter of ACEDS met for a roundtable discussion hosted at the offices of Wilson Elser Moskowitz Edelman & Dicker LLP by its eDiscovery Chair, Daniel M. Braude. 

The board and members of the chapter, along with guests, engaged in a lively discussion on Collecting, Preserving & Reviewing Data from Messaging Systems & Mobile.  For those who were unable to attend, here are some key takeaways.

Mobile messaging, as well as messaging systems and collaboration tools, such as Slack, Quip, etc. and other emerging platforms yet to be named are ubiquitous and here to stay. And the technology is moving at a pace far exceeding most off-the-shelf collection, preservation and review tools.

The consensus at the roundtable is that it is prudent for technologists – project management professionals (PMs) and their attorney counterparts to come together at the earliest point in the process.  This applies for information governance purposes, discovery or some combination thereof.  For example, how effective are ESI protocols and document retention policies without a clear understanding of the technology and its capabilities?  And when PMs and attorneys work together, it will generally lead to less wasted time, fewer write-downs and more profitability.

Remember, technology is only as good as the people who understand and implement it.
