Effective January 30, 2017, the Victoria bar will adhere to a new protocol for handling electronic evidence. The Chief Justice of the Supreme Court of Victoria issued a comprehensive Practice Note regarding technology in pre-trial and at trial. Included is an explicit approval of technology assisted review, including continuous active learning, simple active learning, simple passive learning and any other appropriate system. With Annexures, the document defines metadata requirements and privilege log structures.
