Sedona on Defense of Process: Perfection is Not the Standard

Ken Withers, Deputy Executive Director of The Sedona Conference, announced publication of the Public Comment Version of The Sedona Conference Commentary on Defense of Process: Principles and Guidelines for Developing and Implementing a Sound E-Discovery Process.
Of interest to the ACEDS community are extensive sections on considerations on culling, FRCP 26(g) and “reasonable inquiry”, and prominent assertions that perfection is not the standard. The Commentary explores whether TAR should be held to a higher standard than other methods of data reduction. In contrast to current practice, the Commentary recommends waiting until the close of production for discovery disputes.
