Meet and Confer – Best Practices Under the New Rules

Historically, Meet and Confers have been a crapshoot, when some parties either fail to take the obligation seriously, or come to the meetings completely unprepared, while other parties put a great deal of thought into it. The results reflect the effort dedicated by both of the parties: either highly useful, or largely useless outcomes.

Failed conferences lead to unworkable agreements, or miss the real discovery issues. Because of this, there never is a single winner in a 26(f) conference; either everyone leaves a winner, or everyone leaves a loser. The recent changes to the FRCP emphasize that now, more than ever before, parties need to carry on a meaningful Rule 26(f) conference.

This webcast is a presentation by a panel of practicing experts on best practices in preparing for, executing, and following up to a 26(f) conference under the new Rules. With war stories and practical advice, the Panel will outline the goal-oriented approach necessary to conduct a Meet and Confer that not only meets the standards of the new Rules, but also gives the parties a successful outcome.

Among the topics discussed will be:

    • Strategizing to make cooperation a central focus of the parties’ interactions
    • Planning and preparation needed to address proportionality and other potential discovery issues
    • Identifying efficiencies which help with case management and risk mitigation
